For businesses in Liverpool, the North West, and North Wales, <strong>uploading images to AI tools isn\u2019t just a tech or privacy issue \u2013 it\u2019s a legal one.<\/strong> You\u2019ve heard of GDPR; you know it\u2019s serious about personal data. Well, <strong>your face is personal data<\/strong>. In fact, it can even be classified as biometric data under GDPR, which brings extra strict rules. Let\u2019s unpack the legal and regulatory considerations when using AI tools that munch on images of real people.<\/p>\n\n\n\n<div class=\"wp-block-media-text has-media-on-the-right is-stacked-on-mobile\"><div class=\"wp-block-media-text__content\">\n<h2 class=\"wp-block-heading\">Your Face as Personal (and Biometric) Data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under the UK GDPR, <em>personal data<\/em> is any information relating to an identified or identifiable person \u2013 and a photograph of your face <strong>clearly qualifies<\/strong>. But there\u2019s more: if that image is used for \u201cbiometric identification\u201d (such as facial recognition), it becomes <strong>Special Category Data<\/strong> (sensitive personal data) which has even tighter requirements. Even if you\u2019re just uploading selfies to get a cartoon avatar, <strong>the fact remains that you are processing personal data with a third-party service<\/strong>. If that photo is of someone else (say, your employees or customers in a team pic), you\u2019re processing <em>their<\/em> personal data.<\/p>\n<\/div><figure class=\"wp-block-media-text__media\"><img data-recalc-dims=\"1\" height=\"600\" width=\"900\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/www.hiltdigital.co.uk\/wp-content\/uploads\/2025\/04\/pexels-photo-3861969-3861969-1024x683.jpg?resize=900%2C600&#038;ssl=1\" alt=\"A woman with digital code projections on her face, representing technology and future concepts.\" class=\"wp-image-2376 size-full\"\/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">What does this mean practically? And if the service is using those photos for anything beyond just giving you an image (for example, training their AI on facial features), it could count as biometric processing. The law hasn\u2019t caught up to selfie apps directly, but <strong>it\u2019s safer to assume GDPR <em>does apply<\/em><\/strong> \u2013 and that regulators care about how these tools handle data. (Remember how the ICO \u2013 UK\u2019s Information Commissioner\u2019s Office \u2013 cracked down on Clearview AI for scraping faces off the web\u200b <a href=\"https:\/\/www.theguardian.com\/technology\/2022\/may\/23\/uk-data-watchdog-fines-facial-recognition-firm-clearview-ai-image-collection#:~:text=The%20Information%20Commissioner%E2%80%99s%20Office%20,and%20from%20scouring%20the%20web\" target=\"_blank\" rel=\"noreferrer noopener\">theguardian.com<\/a>? That shows how regulators view misuse of facial data as \u201cunacceptable\u201d \u200b<a href=\"https:\/\/www.theguardian.com\/technology\/2022\/may\/23\/uk-data-watchdog-fines-facial-recognition-firm-clearview-ai-image-collection#:~:text=John%20Edwards%2C%20the%20UK%20information,than%2020bn%20images%2C%E2%80%9D%20he%20said\" target=\"_blank\" rel=\"noreferrer noopener\">theguardian.com<\/a>.)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Terms and Conditions: What Did You Agree To?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From a legal perspective, those lengthy terms of service in AI apps are essentially contracts. When you or your employees click \u201cAccept,\u201d you might be agreeing to all sorts of provisions that could conflict with your own data protection policies. As we saw earlier, FaceApp\u2019s terms required users to confirm they had rights\/permissions to upload each photo\u200b <a href=\"https:\/\/www.capitallaw.co.uk\/news\/faceapp-time-to-face-up-to-the-truth-about-copyright-licences\/#:~:text=By%20agreeing%20to%20the%20Terms,the%20content%20via%20the%20app\" target=\"_blank\" rel=\"noreferrer noopener\">capitallaw.co.uk<\/a>. This means if an employee uploads a group shot from your company event, and they <em>didn\u2019t get everyone\u2019s consent<\/em>, <strong>your company could be on the hook<\/strong> for that lapse. The app\u2019s terms basically say <em>\u201cif there\u2019s a problem, it\u2019s the user\u2019s fault, not ours.\u201d<\/em> So an unwitting employee might breach privacy rules and the company gets the blame.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moreover, by agreeing to broad licenses (like the perpetual license in FaceApp\u2019s terms), you may be violating principles of data protection such as data minimization and purpose limitation. GDPR says you should only collect and share personal data for specific, legitimate purposes. If an app can use your uploaded images for <em>anything<\/em> (advertising, machine learning, etc.), is that purpose clear and limited? Unlikely. There\u2019s a real tension between these app agreements and GDPR\u2019s spirit. <strong>For UK businesses, the safest assumption is that uploading identifiable photos to a consumer-grade AI tool equals sharing personal data with a third-party processor.<\/strong> You\u2019d ideally need a Data Processing Agreement, adequate safeguards, etc., just as you would when outsourcing any data processing \u2013 things most people <em>definitely<\/em> don\u2019t obtain from a phone app!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">International Data Transfers (AKA \u201cWhere\u2019s Your Face Going?\u201d)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When you upload an image to an app, do you know where it\u2019s sent? As mentioned, many popular AI services are run by companies outside the UK\/EU. For example, Lensa is operated by a U.S. company with servers in the U.S.\u200b <a href=\"https:\/\/abc7.com\/lensa-ai-art-generator-image-app-prisma-labs\/12540081\/#:~:text=particular%20user%20has%20uploaded%2C,S\" target=\"_blank\" rel=\"noreferrer noopener\">abc7.com<\/a>. That means your photo is zipping across international borders. Under UK GDPR, transferring personal data abroad (especially to the US or other countries without an adequacy decision) requires safeguards \u2013 typically Standard Contractual Clauses and an assessment of the receiving country\u2019s data protection. Now, <strong>do AI avatar apps offer you a UK GDPR-compliant data transfer agreement upfront?<\/strong> Highly unlikely. They might mention in their privacy policy that by using the service you consent to your data going to wherever they operate. But consent under GDPR has to be explicit and informed for it to count in this context, and most users are not truly informed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This presents a compliance risk. If a UK business is found to be routinely uploading personal images to an app that ships data to (say) the US or Russia without proper measures, the ICO could view it as an unlawful transfer. Admittedly, the ICO isn\u2019t scanning for small instances like \u201cBob in Accounting uploaded team selfies to FaceApp,\u201d but if a larger issue came up (say a data breach or a complaint by an employee), this could become a headache. <strong>The safe play for businesses is to treat any cloud AI tool as you would any new software vendor \u2013 vet it for data protection compliance.<\/strong> If it\u2019s not clear where data goes and how it\u2019s protected, that\u2019s a red flag.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Employee and Company Liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s talk about employees. We know folks love trying new apps \u2013 maybe someone on your marketing team is experimenting with AI-generated headshots to use on the company \u201cAbout Us\u201d page. It sounds innovative, but make sure they understand the rules. If an employee uploads a photo of a client or another staff member to an AI tool without permission, your company could be violating privacy rights. Under GDPR, <strong>each person in a photo has rights<\/strong> \u2013 the right to know where their data goes, to object, etc. An employee having fun with an app could accidentally trigger those issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There\u2019s also the question of <strong>biometric data<\/strong>: If an AI tool is extracting a facial template or \u201cembedding\u201d from the photo (a numerical representation of your facial features), that could be seen as biometric processing. Biometric data usage under GDPR often requires explicit consent or a strong necessity (like security). Using it for amusement or even minor convenience probably wouldn\u2019t meet the bar. So if an employee uses a face-login feature or face-analyzing AI without clearance, it might put your firm in a legally murky area.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short, <strong>educate your team<\/strong>: not every app is OK to use with work-related images. Just as you\u2019d (hopefully) caution against uploading company documents to random websites, extend that caution to images of people. The legal onus is ultimately on the company (the data controller) to ensure compliance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">GDPR, AI and the Road Ahead<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Regulators are increasingly aware of AI risks. While there\u2019s no specific \u201cAI avatar law\u201d yet, frameworks like the EU\u2019s upcoming AI Act and existing privacy laws are circling closer. The prudent approach for business owners is to <strong>err on the side of caution and transparency<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Document what you\u2019re doing<\/strong> \u2013 If you decide to use any AI tool involving personal data, document the purpose and ensure it\u2019s defensible under GDPR (e.g. you have individuals\u2019 consent or a legitimate interest that isn\u2019t overridden by their rights).<\/li>\n\n\n\n<li><strong>Read the Privacy Policy<\/strong> \u2013 Boring, yes, but you might discover that the app stores data longer than you thought or shares it with partners. For instance, if an app\u2019s policy says data <em>\u201cmay be used to improve our services\u201d<\/em>, that implies your images could be retained for AI training. Does that clash with your own privacy notices to staff or users?<\/li>\n\n\n\n<li><strong>Stay Updated on Guidance<\/strong> \u2013 The ICO periodically releases guidance on new tech. Biometric data and AI are hot topics.
